The AskPath website is a consumer educational pathology website designed to help bridge the gap between clinicians and patients. By using the AskPath website, you (“User”) hereby consent to Askpath’s Terms of Use and Statement of Privacy. AskPath encourages Users to read its Terms and Conditions and Statement of Privacy carefully.

Any and all information provided by AskPath, LLC, (“AskPath”) including any and all content made available on AskPath’s website, including, but not limited to text, graphics, images, articles, and other documents, whether or not available for download from AskPath’s website, are made available solely for educational purposes and shall be used as an educational resource only.

AskPath does not and shall not provide medical diagnosis, treatment or cure for any medical condition and any content made available on its website is not intended, and should not be accepted, as medical diagnosis, treatment or cure of any medical condition. Reliance on any of the content contained on the site, whether provided by AskPath or any of its affiliates is solely at your own risk. AskPath extends no warranties whatsoever, and makes no claims, promises, or guarantees as to the content made available on its site regarding your specific medical condition and asks that you neither ignore, nor disregard the professional medical advice rendered by your licensed physician or other qualified healthcare provider.

Any and all information obtained from AskPath’s website, shall not be a substitute for professional medical advice, diagnosis, treatment and/or cure from your licensed physician or other qualified healthcare provider. AskPath does not recommend self-management of any health condition. Nor does AskPath endorse any physician or healthcare provider, diagnostic test, product, treatment modality, medical opinion, procedure or other information that may be referenced on its site and recommends that you always seek the advice of your licensed physician or other qualified healthcare provider with any questions you may have regarding a medical condition.

Terms and Conditions

The AskPath website and the services provided by AskPath are not intended for use by those under the age of 18. Any user of AskPath’s website must be at least 18 years of age. AskPath reserves the right to take appropriate legal action including referral to law enforcement, for any illegal or unauthorized use of AskPath’s website and additionally reserves the right take any appropriate action to prevent the unauthorized use of AskPath’s intellectual property. AskPath may cooperate with any law enforcement authorities or court order requesting or directing AskPath to disclose the identity of or locate any user for the prevention or detection of crime, or the apprehension or prosecution of offenders. You hereby waive and hold AskPath harmless from, any claims resulting from such disclosures, and from any actions undertaken by either AskPath or law enforcement authorities to investigate such claims. AskPath may investigate any complaint or reported breach of its Privacy Statement and may take any action deemed appropriate, including suspension or termination of your access to the AskPath website at any time and without notice, if AskPath has reasonable grounds to believe that you have breached its Privacy Statement or its Terms of Use.

User Accounts

Users establishing an account on Askpath must be of legal age of 18 years old. User will create a username and password for access to your online account and should keep this information confidential by not sharing this information with others. Users will immediately notify AskPath of any unauthorized use of their password or account. Users should only create one account on the site. If a User’s AskPath account has been suspended or terminated, the user may not open another account on the site.

Users agree to keep any User contact and billing information (including but not limited to email address) up-to-date, and to comply with all billing procedures, including providing and maintaining accurate and lawful billing information for active AskPath accounts.

Representatives

Users are responsible for and bound by the actions of, and transactions entered into by, said User’s actual and appointed representatives whether authorized by User in writing, verbally, or otherwise to represent the user at or with AskPath.. Users are responsible for monitoring their appointed representatives and protecting the privacy of the username, login information and any other account or financial information provided to AskPath or its vendors and agree to inform us immediately, in writing, of any unauthorized use of same. If checking in or logging in as a representative for anyone other than yourself, you agree that you are a duly appointed and authorized representative for that person or entity and have authority to bind that person or entity to any actions or transactions you conduct.

Restricted Activities

Users agree that any content provided by the User on the site and a User’s use of our site or any additional services (whether such additional services are informational, as defined below) initiated through the site shall not: (a) be fraudulent, inaccurate or misleading; (b) infringe any third party’s proprietary rights or rights of publicity or privacy (c) be illegal or violate any federal, state or local law, statute, ordinance, regulation or ethical code; (d) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (e) be obscene or contain child pornography or, if otherwise adult in nature or harmful to minors, but without containing child pornography; (f) contain any viruses, Trojan horses, or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (g) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; or (h) link directly or indirectly to or include descriptions of goods or services that are prohibited under the Terms or that you do not have a right to link to or include. If you post material that is adult in nature, such material shall be posted with “Mature Audiences Only” in the listing title and appropriate notices to prevent unauthorized underage viewing and shall be distributed only to people legally permitted to receive such content (Information on Parental Control Protections). Users may not consummate any transaction that was initiated using our Service that, by paying to us a fee, could cause us to violate any applicable law, statute, ordinance or regulation. Furthermore, Users may not resell or make any commercial use of our system or the content on the site without AskPath’s prior written consent. AskPath does not and will not knowingly collect personal information from any person under the age of 18 and if AskPath becomes aware that a person under the age of 18 has submitted personal information to AskPath, the information will be promptly removed from our systems.

Privacy

AskPath will not sell trade, give or allow any type of access to any user information supplied to AskPath by its Users unless authorized by the user. This information will only be supplied to another medical professional office in support of diagnosing a user’s case.

Suspension or Termination of Service.

Users may terminate services and associated accounts at User’s sole discretion and at any time by written notice via e-mail to questions@AskPath.com. Terminations will be effective within seven (7) business days after receipt of User’s termination notice, at which time the User account will be closed. Any fees accrued as of the effective date of termination will be payable according to the Terms.

At any time, with or without notice, for any or no reason, AskPath reserves the right to modify or discontinue any portion or all of the site or services, and to restrict, suspend and terminate customers’ accounts.

Charges

AskPath allows Users (“Customers”) to ask questions to experts in subject-matter categories, through the website and enables delivery of answers to your questions, among other services. Users on the site who are “patients” may register for free. Users who are patients are able to put money into their wallet and pay on a per question basis. With free membership, patients are able to receive newsletters, view any frequently asked questions, and any other information on the website.

Users who are physicians are able to purchase membership packages which allow multiple questions and access to a physician portal, and quarterly peer review articles on relevant topics in medicine. With the physician package, doctors will receive a set of tokens for questions which they can use and distribute to their patients the website.

Membership

Memberships allow Users who are physicians to receive Site Access Benefits for multiple questions on the Site for a monthly or other-period recurring fee. Users who elect to pay for memberships are hereinafter referred to as “Members.” The fee is automatically charged to the Member’s payment source provided on the Site and placed in the User Payment Pool (account of all Members’ payments). AskPath will send at least one email notice of upcoming auto-renewal prior to auto-renewing your membership. Auto-renewal will remain in effect until withdrawn by you or terminated by AskPath. Users can stop auto-renewal of their membership by sending a written notice of cancellation via e-mail to kdavis@askpath.com. User’s withdrawal must be received by AskPath at least thirty (30) days before the renewal effective date with respect to the next billing cycle. At the end of each payment period, any portion of the AskPath Membership fee remaining in the Customer Payment Pool will be paid to AskPath as compensation for the Site Access Benefits to which you were entitled during the payment period.

AskPath memberships are non-transferrable, not-for-resale use and may be used only by the Member User or their authorized representative. Content found on the AskPath site shall not be used for purposes of plagiarism in any context or in cheating in the academic setting. Notwithstanding any contained herein, AskPath reserves the right to cancel any User membership in its entirety at any time and for any reason, with or without prior notice, including, but not limited to, a User’s excessive use (as determined by AskPath in its sole and reasonable discretion). In the event that AskPath cancels a membership, it will refund the current period’s fee.

In order to prevent fraudulent use of the Membership program by Customers, Customers who have purchased memberships are ineligible to participate as experts on the AskPath site during the term of their membership, as are their immediate family members (spouse, parent, child, sibling and spouse or “step” of each) and those living in the same households (persons, whether related or not, who lived in the same residence as the Member for at least three (3) months during the twelve (12)-month period preceding the start of the AskPath Membership).

Refunds, Cancellations, Abuse and Special Programs.

No Refunds except as set forth herein. All membership fees and question purchases are non-refundable. Memberships that are cancelled in the middle of the payment period will not have pro-rated billing, refunds or other credits.

AskPath maintains the right to initiate special incentive pricing, membership, and other programs. These may be limited, at AskPath’s sole discretion, to defined and limited Users or non-Users. Any promotional monies or credits placed into customer accounts by AskPath for use towards site access on the site remain the property of AskPath (they never become the property of customers and never become refundable to the customer), and unless otherwise stated on the Site or in an email to a Customer, will be usable only for thirty (30) days.

Statement of Privacy

AskPath is committed to protecting and respecting your privacy and your personal information. Personal information is any information about you, which is personally identifiable (“Personal Information”), that AskPath may collect from you through your use of the AskPath website. AskPath’s Statement of Privacy explains how AskPath may use, treat or disclose your Personal Information. For the purposes of this Privacy policy, unless otherwise noted, all references to AskPath shall include www.askpath.net. AskPath encourages you to read this statement carefully so that you will understand how AskPath may use, treat or disclose your Personal Information.

This Statement of Privacy applies only to Personal Information collected by AskPath for the purpose of AskPath’s provision of services and/or products to you. It does not apply to Personal Information collected on any third-party website(s), even if such website is accessed through links contained on the AskPath website. The privacy policies and/or practices of the third-party site may differ from those of AskPath. You should review the privacy policies and/or practices of that site after leaving the AskPath website. AskPath does not own, maintain or control the third-party website and is therefore not responsible for any of the content, privacy policies and/or practices of any non-AskPath website. AskPath does not collect any personal information about you unless you voluntarily provide it. Personal information may include: Your name, mailing address, email address, telephone number, and billing and credit card information and/or any other personal information provided by you. All such information may be required when: (a) registering for an account on our Site; (b) entering a sweepstakes or contest sponsored by AskPath or one of its partners; (c) signing up for special offers from selected third parties; (d) sending AskPath email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services on our Site. Your personal information will be used to communicate with you (a) in relation to services and/or products you purchase from AskPath; (b) inform you of other products or services made available from AskPath and/or its affiliates; (c) assist you with any questions you may have regarding AskPath’s services, payment methods, and processing; (d) collecting payments made in connection with the rendering of Askpath’s services to you and; (e) technical personnel hosting of the AskPath website. If You do not want AskPath to use your Personal Information in this way, please contact AskPath at the details below. AskPath strives to take reasonable security measures to protect against unauthorized access to, or alteration of your personal information through use of Secure Socket Layer (“SSL”) technology. In using this technology, when transmitting personal information, the information is protected through encryption. Despite AskPath’s efforts to protect your personal information, the risk of interception by a third-party remains a possibility. To this end, you acknowledge that: (a) there are security and privacy limitations inherent to use of the Internet, which are beyond AskPath’s control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and the AskPath website cannot be guaranteed. AskPath will not share, sell, trade, loan or otherwise disclose any Personal Information to any third party, unless permitted by you or otherwise authorized to do. AskPath reserves the right to disclose Personal Information pursuant to its obligation to: (a) comply with proper requests from any law enforcement agency, court, regulatory, or government authority; (b) protect and/or defend AskPath’s rights or property or; (c) act under exigent circumstances to protect the personal safety of a user of AskPath or the general public. Additionally, AskPath may also disclose Personal Information to a third party in connection with the sale, assignment, or other transfer of the business of AskPath’s Website and shall require that such third party agree to treat Personal Information in accordance with AskPath’s Terms of Use.

Use of Cookies

The AskPath website may use cookies to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. For example, if you personalize AskPath pages, or register with AskPath website for services, cookies will help AskPath recall your specific information on subsequent visits. From time to time, AskPath may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. If you would like to stop receiving marketing or promotional communications via email from AskPath, you may opt out of such communications by unsubscribing.

Changes to this Statement

AskPath reserves the right to change this Statement of Privacy from time to time. You will be notified of any significant changes in the way AskPath treats Personal Information via notice to the primary email address specified in your account and notice on our site regarding any updated privacy information. Your continued use of the site and/or services available through the site after such changes will constitute your: (a) acknowledgment of the changes in AskPath’s Statement of Privacy; and (b) your agreement to abide and be bound by that Policy.
